Can Creditors continue to pursue me for Debts after an IVA has Finished?
A creditor cannot pursue you after an IVA has been successfully completed. In fact, an IVA cannot go through until creditors agree to the final settlement amounts.
What you are doing when you apply for an IVA is basically playing a bargaining game with your creditors. You have to owe multiple creditors in order to qualify for an IVA. All creditors that you owe are to be included in the IVA in order for the process to be done successfully.
You, which are the borrower, will make an agreement with the creditors. Many IVA’s require you to pay a fixed amount to your creditors for a 5 year period. With you keeping to your side of the agreement your creditors are prohibited to pursue any legal action against you. The creditors also can no freeze any interest or write anything off, until the IVA process has been completed.
The IVA can not finish until all creditor agree to allow you to repay a certain percentage of the debt back to them. You will be able to repay your creditors with what the necessary means you have to pay them. The IVA is not in no ways meant to make you have to sacrifice anything. You are basically told to pay what you can afford, so this way you can still obtain a regular lifestyle.
Creditors can in no means pursue you after an IVA has finished. They openly have to agree to all terms and conditions in order for you to be able to file an IVA. So the creditors will have no reason to come back against you for anything. As long as you adhere to all the requirements while on the IVA, your credit will quickly improve and you will never have to hear from any of your prior creditors ever again.
