If the proceedings have been threatened or even commenced against you, it may still be possible for you to avoid bankruptcy. You will need to seek advice as soon as possible. Getting out of an Existing Bankruptcy
We have seen a rise this year in people made bankrupt for non-payment of Council Tax. The initial sum involved is modest but the consequences if you don’t act quickly are severe. Often the key to resolving the bankruptcy is to get the bankruptcy annulled. This is possible when you have sufficient assets to be able to pay all of your creditors in full. This is usually done by either a re-mortgage of your home or a family member paying off the debts. Once the Court is satisfied the funds are available to pay all bankruptcy debts and costs they have the power to annul the bankruptcy. It is possible to have the bankruptcy annulled if an IVA is approved by your creditors.

Already Bankrupt, Trustee trying to take your home?
Once you become bankrupt your assets, including your share in your house vest in your Trustee. The Trustee has three years to realise this interest or they will lose all rights to it.
